General Terms and Conditions of Sale
Preamble
These general terms and conditions of sale apply to all services provided by Make More Studio. The client is required to read these terms and conditions before entering into any contract. The choice and purchase of a service is the sole responsibility of the client. By concluding a contract, the client acknowledges having read and accepted the terms and conditions. The validation and signature of the contract constitute acceptance of the general terms and conditions of sale.
Article 1 - Content and Scope of Application
These general terms and conditions of sale apply automatically to the following services: creation and production of content for social media - photographs, videos, and caption writing - and development of digital marketing strategies. The sale is deemed concluded on the date of contract signing. Any contract signed for the purchase of services offered by Make More Studio implies unconditional acceptance of these terms and conditions, which prevail over any other terms, except those explicitly accepted by Make More Studio and specified in the sales contract. The client acknowledges having read and accepted these general terms and conditions of sale before making an immediate purchase or upon contract signing.
Article 2 - Pre-contractual Information
Prior to immediate purchase or contract signing, these general terms and conditions of sale are provided to the client, who acknowledges having received them.
The following information is clearly and comprehensibly communicated to the client:
Essential characteristics of the services offered for sale by Make More Studio.
Price of the service and, if applicable, any additional transportation, delivery, or postage fees, as well as any other potential costs.
Date or deadline by which Make More Studio commits to providing the service, irrespective of its price and any other contractual conditions.
Information regarding the identity of the service provider, including postal, telephone, and electronic contact details, as well as business activities.
Procedures for handling complaints.
Duration of the contract when concluded for a fixed term.
Make More Studio commits to providing the client with the legal status and form of the company, as well as the contact details to communicate directly with them.
Article 3 - Order
By order, it is understood as any request for services and products listed in Make More Studio's price list, accepted by the client along with the payment of the deposit specified in the contract. All purchases of services or products must be detailed in the contract and made available to the client in advance to be valid. Any contract signed by the client and received by the seller implies full acceptance of these general terms and conditions of sale and the obligation to pay for the ordered services. The client has a 7-day right of withdrawal from the date of contract conclusion, except as provided by Article L.221-28 of the Consumer Code.
Article 4 - Packages and Quotations
Any sale of a package is only considered final after contract signing. For services requiring a prior quotation, the sale is only considered final after the previously drafted and sent quotation is signed by the client and received by Make More Studio. Quotations provided by the company are valid for 30 days.
Article 5 - Execution of Services and Subscription Contract Termination
5-1. Unless otherwise expressly agreed, the provision of services subscribed by the client will only take effect upon receipt of the products, following the proper receipt of the signed contract by Make More Studio. The client has 15 days after contract signing to send the products to the address indicated in the contract – postmark as proof.
In case of failure by the provider to fulfill its obligations within the agreed timeframe, the client may terminate the contract in accordance with Articles L.216-2, L.216-3, and L.216-4 of the Consumer Code, by registered letter with acknowledgment of receipt, or in writing on another durable medium. If, after being urged, under the same conditions, the professional does not provide the service within a reasonable additional period, the contract is deemed terminated upon the professional's receipt of the letter or writing informing them of this resolution, unless the professional has performed in the meantime. However, the client may immediately terminate the contract if the professional refuses to provide the service or fails to fulfill its obligation to provide the service within the agreed timeframe. The costs and risks associated with this operation are solely borne by the provider. Except in cases of force majeure, the deposit paid upon order is automatically acquired and cannot be refunded.
5-2. Any package subscribed with Make More Studio is subject to a detailed contract sent by email to the client. This contract includes the designation and type of service determined based on the client's request, as well as the associated terms and costs. Each subscription commits the client for two months, automatically renewable without contrary notification from the client. These general terms and conditions of sale, the subscribed and detailed option and/or the specific quotation drafted in advance and accepted by the client, as well as any documents issued by Make More Studio related to the subscription service, excluding any other document issued by Make More Studio and having only indicative value, form the contract.
Article 6 - Withdrawal Period, Refund, and Subscription Termination
6-1. The client has a 7-day right of withdrawal from the date of contract signing. The client will receive a full refund of all amounts paid within 7 days from the date Make More Studio is informed of the client's decision to withdraw, in accordance with Article L.221-24 of the Consumer Code, unless justified delay. Any modification or resolution of the service subscribed by the client is subject to Make More Studio's express agreement and must be made within 7 days following the contract termination. After this period, the service subscription remains valid and must be fully paid by the client.
6-2. Order cancellation after withdrawal period
After the 7-day withdrawal period, in case of order cancellation by the client, no refund will be made. The client is committed for a period of two months and must pay the agreed amount in the contract, equivalent to two months of subscription to Make More Studio.
6-3. Subscription Termination
Each contract commits the client for a minimum period of two months and is automatically renewed. In case of subscription termination, the client must explicitly notify their request in writing by email with acknowledgment of receipt or by registered letter, at least one month before the desired termination date, and send it to Make More Studio by registered letter. In case of termination without one-month notice, the client must pay an amount equivalent to one month of subscription. Termination will take effect the following month.
Article 7 - Rates and Payment
The rates for various subscriptions and packages are firm and final. Unless otherwise expressly agreed, the prices of the services offered are those listed in the catalog on the day of the order. They are expressed in legal currency (Euro) and inclusive of all taxes (VAT).
Additional fees may apply based on specific client requests. A personalized and detailed quotation will then be drafted and proposed to the client.
7-1. Unless otherwise specified in the special conditions, subscription payment must be made at the beginning of the month and upon contract signing. No subscription will be considered without an initial payment on this date. A deposit representing one-third of the amount equivalent to two months of commitment, paid upon contract signing, is required when subscribing to a package by the client. Unless otherwise indicated for any subscription contract concluded between a professional and a consumer, advance payments are considered as down payments, in accordance with Article 1590 of the Civil Code.
Payment Terms:
Payment of an initial one-third deposit of the total amount for two months of subscription upon contract signing;
Payment of a second installment of one-third of the total amount for two months of subscription 30 days after contract signing;
Payment of the final one-third of the total amount for two months of subscription 60 days after contract signing;
If the subscription is automatically renewed after the initial two months of commitment, the monthly payment will be equivalent to the monthly subscription price.
The dates for the various payments are stipulated in the subscription contract concluded between the client and Make More Studio. The client will receive an invoice at the end of each month via email and must settle the invoice amount within 10 days of receiving the invoice. The subscription contract is considered concluded upon receipt and cashing of the first payment. It is the client's responsibility to verify the accuracy of the subscription and immediately report any errors.
Payments are made exclusively by bank transfer to Make More Studio's bank account, the details of which will be provided to the client upon conclusion of the subscription contract.
7-2. In case of late payment and failure to pay the amounts due by the client beyond the above-mentioned deadlines and after the payment date indicated on the invoice sent to them, late payment penalties calculated at the legal rate applicable to the VAT-inclusive price of the acquisition listed on the invoice are automatically and without further notice acquired by Make More Studio. Late payment will result in the immediate demand for the full amount due by the client, without prejudice to any other action that Make More Studio may be entitled to take against the client. Make More Studio reserves the right, in case of non-compliance with the above payment conditions, to suspend or cancel the provision of services subscribed by the client.
Article 8 - Products
All products must be shipped within 15 days following contract signing – postmark as proof. Any product sent to Make More Studio will be retained by the company and cannot be returned, except in exceptional cases. If a product needs to be returned after being used in the context of the agreed services, this must be expressly specified in the contract and approved by Make More Studio in advance.
Article 9 - Intellectual Property
All content created by Make More Studio, including videos, photographs, and textual content, remains the property of Make More Studio. The company reserves the right to use this content for advertising and promotional purposes on any medium. The client is not authorized to modify the content created by Make More Studio, whether it be videos, photographs, or texts of various posts.
Article 10 – Competent Jurisdiction
Any disputes arising from the purchase and sale operations concluded under these general terms and conditions of sale, concerning their validity, interpretation, execution, termination, consequences, and follow-ups, which could not be resolved amicably between the seller and the client, shall be submitted to the competent courts under common law. For the definition of the competent jurisdiction, the provider elects domicile at 49 rue basse, 30360 Vézénobres.
Article 11 – Contract Language
These general terms and conditions of sale are written in French. In the event that they are translated into one or more foreign languages, only the French text shall prevail in case of dispute.
Article 13 – Applicable Law
These general terms and conditions of sale are subject to French law. The competent court is the district court for disputes with an amount less than or equal to €10,000 or the high court for disputes with an amount greater than €10,000. This applies to substantive rules as well as procedural rules. In case of dispute or complaint, the client should first contact MAKE MORE STUDIO to seek an amicable solution.
Article 14 – Protection of Personal Data
14-1. The personal data collected by Make More Studio includes:
Contact form on the website: name, email address, social media profiles.
Creation of a client file during the 1st meeting: name, email and postal address, phone number, profession/business.
Cookies: The cookies used during the use of the website. Users have the option to disable cookies from their browser settings.
14-2. Use of personal data:
The data collected from clients aims to provide website services, improve them, and maintain a secure environment. Specifically, the uses are as follows: access and use of the website by the user, management of the website's operation and optimization, prevention and detection of fraud, malware (malicious software), and security incidents, as well as managing any disputes with users.
14-3. Sharing of data with third parties:
Personal data may be shared with third-party companies in the following cases:
If required by law, the website may transmit data to respond to claims against the website and comply with administrative and judicial procedures.
If the website is involved in a merger, acquisition, asset sale, or judicial reorganization procedure, it may be required to transfer or share all or part of its assets, including personal data. In this case, users would be informed before personal data is transferred to a third party.

14-6. Evolution of this clause:
